China, EU reach deal on solar panel dispute

BRUSSELS, July 27 (Xinhua) -- The China Chamber of Commerce for Import and Export of Machinery and Electronic Products and the European Commission have reached a deal to resolve a dispute involving solar panels.
"After weeks of intensive talks, I can announce today that I am satisfied with the offer of a price undertaking submitted by China's solar panel exporters," EU Trade Commissioner Karel De Gucht said in a statement, referring to an agreement for a minimum price for China's imports.
"We found an amicable solution ... that will lead to a new market equilibrium at sustainable prices," De Gucht said.

The Commissioner said the next step for him is to table this offer for approval by the European Commission.
Further details of the legal acts concerning the undertaking arrangement can only be released following their adoption by the Commission.
The Chinese Ministry of Commerce, meanwhile, said China welcomes the deal which "showcased pragmatic and flexible attitudes from both sides and the wisdom to resolve the issue."
According to the Ministry of Commerce spokesman Shen Danyang, resolving the trade dispute is conducive to an open, cooperative, stable and sustainable economic and trade relationship between China and the EU.
He added that China is willing to further promote exchanges and cooperation with the EU side in the photovoltaic industry field.
Chinese solar panel production quadrupled between 2009 and 2011 to more than the entire global demand, and the Commission accused China of dumping its solar panels at below the cost of production in Europe.
The European Commission on June 4 decided to impose provisional anti-dumping duties on imports of solar panels, cells and wafers from China.
Starting from June 6, EU imports of Chinese solar products was subject to a punitive duty of 11.8 percent until August 6, from when on, the duty would have been raised to 47.6 percent if the two sides could not sort out the dispute through negotiations.

    Im Streit um chinesische Solarimporte haben sich die EU und China geeinigt. Doch der Solar-Branche passt die Einigung überhaupt nicht. Unternehmen planen den Gang vor den Europäischen Gerichtshof.

    Die Europäische Union und China haben ihren monatelangen Dumping-Streit um den milliardenschweren Solarmarkt beigelegt. "Wir haben eine einvernehmliche Lösung gefunden, die zu einem neuen Gleichgewicht auf dem europäischen Markt mit nachhaltigen Preisen führen wird", sagte EU-Handelskommissar Karel De Gucht.

    EU-Diplomaten zufolge einigte man sich auf einen Mindestpreis von etwa 57 Cent pro Watt und eine maximale Einfuhr von chinesischen Modulen mit einer Leistung von sieben Gigawatt pro Jahr, was etwa 70 Prozent des Marktes entspricht. Die EU-Hersteller-Initiative Pro Sun, die das Dumpingverfahren angestoßen hatte, kündigte umgehend Klage vor dem Europäischen Gerichtshof an: "Eine Einigung auf dem Level der heutigen Dumpingpreise verstößt gegen EU-Recht", sagte Pro-Sun-Präsident Milan Nitzschke.

    Mit dem Kompromiss wollen die EU und China einen Streit beilegen, der in einen Handelskrieg zu münden drohte. Im Konflikt geht es um Einfuhren von zuletzt 21 Milliarden Euro im Jahr. Nachdem die Kommission bereits vorläufige Zölle von 11,8 Prozent verhängt hatte, konterte China mit Verfahren gegen andere EU-Produkte wie Wein. Auch drohte China mit einem Zoll auf Polysilizium, einem Grundstoff für die Solarindustrie, war vor allem den deutschen Produzenten Wacker Chemie getroffen hätte. Wäre eine Verständigung bis zum 6. August ausgeblieben, wären automatisch Zölle von rund 48 Prozent auf chinesische Solar-Importe fällig geworden. Ein ähnliches Verfahren hatte es bereits in den USA gegeben, wo sich Hersteller ebenfalls gegen China-Importe gewehrt hatten.
    Rösler: Verhandlungslösung besser als Konflikt

    Deutschland und Bundeskanzlerin Angela Merkel hatten aber von Anfang an auf einen Beilegung des Konflikts mit China als wichtigem Absatzmarkt für deutsche Exporteure gedrängt. Entsprechend erleichtert zeigte sich die Regierung: "Wir haben immer darauf hingewiesen, dass eine Verhandlungslösung besser ist als ein Konflikt, der den Wirtschaftsbeziehungen insgesamt schaden würde", sagte Wirtschaftsminister Philipp Rösler (FDP). Er hoffe, dass der Streit nun schnell abgeschlossen werden könne. Ein Sprecher von Chinas Handelsministerium lobte die Vereinbarung als ein "positives und sehr konstruktives Ergebnis".   2. ΕΕ-Κίνα: Οι Βρυξέλλες και το Πεκίνο Διευθέτησαν «Φιλικά» την Διενεξή τους για τα Φωτοβολταϊκά...

    Η Κίνα και η Ευρωπαϊκή Ένωση διευθέτησαν την εμπορική διένεξή τους σχετικά με τις εισαγωγές κινεζικών φωτοβολταϊκών, όπως ανακοίνωσε σήμερα ο ευρωπαίος επίτροπος Εμπορίου Κάρελ ντε Χουχτ.
    Όπως μεταδίδει το ΑΠΕ-ΜΠΕ, οι δύο πλευρές συμφώνησαν στο να καθοριστούν ελάχιστες τιμές για τις εισαγωγές στην ΕΕ των κινεζικών φωτοβολταϊκών προϊόντων μετά από μια διελκυστίνδα έξι εβδομάδων, ανέφερε ο Ντε Χουχτ, ο οποίος έκανε λόγο περί επίτευξης μιας «φιλικής λύσης».
    Η συμφωνία απέτρεψε την περαιτέρω κλιμάκωση της παρατεταμένης διμερούς εμπορικής διένεξης, η οποία χαρακτηρίζεται δίχως προηγούμενο δοθείσης και της υψηλής εμπορικής αξίας των κινεζικών ηλιακών συλλεκτών και γενικότερα των φωτοβολταϊκών – ο όγκος των συναλλαγών στην αγορά αυτή υπολογίζεται στα 28 δισ.
    ευρώ το χρόνο.
    Η ΕΕ είχε κατηγορήσει τις κινεζικές βιομηχανίες κατασκευής φωτοβολταϊκών για ντάμπινγκ στην ευρωπαϊκή αγορά. Οι κρατικές ενισχύσεις και επιχορηγήσεις στην Κίνα τους επέτρεπε να πωλούν τα προϊόντα τους σε τιμές κάτω του κόστους στην Ευρώπη, όπως είχε καταγγείλει.
    Οι κανόνες αντιντάμπινγκ του Παγκόσμιου Οργανισμού Εμπορίου επιτρέπουν στα κράτη μέλη του ΠΟΕ να προστατεύουν τις εγχώριες βιομηχανίες τους από τον αθέμιτο ανταγωνισμό.
    Η συμφωνία αυτή επιτεύχθηκε μόλις μία εβδομάδα πριν την λήξη της προθεσμία που είχε ορίσει η Ευρωπαϊκή Ένωση, την 6η Αυγούστου, όταν οι Βρυξέλλες θα επέβαλαν τιμωρητικούς δασμούς ύψους 47,6%. Ήδη από τον Ιούνιο είχαν επιβληθεί προσωρινοί δασμοί 11,8%.
    «Είμαι ικανοποιημένος για την προσφορά μιας τιμής [εισαγωγής] που υπέβαλαν οι κινεζικές εταιρείες που εξάγουν ηλιακούς συλλέκτες», ανέφερε ο επίτροπος Ντε Χουχτ. Πρόσθεσε πως ελπίζει ότι η συμφωνία αυτή «θα συμβάλλει να βρεθεί μια νέα ισορροπία στην αγορά».
    Η παραγωγή ηλιακών συλλεκτών στην Κίνα υπερτετραπλασιάστηκε από το 2009 ως το 2011, ξεπερνώντας το σύνολο της παγκόσμιας ζήτησης.

    Europäer und Chinesen atmen auf: Ihren Streit über europäische Strafzölle auf chinesische Solarimporte haben sie in letzter Sekunde beigelegt. Massive Kritik daran kommt ausgerechnet von den europäischen Solarunternehmen.

    Nach einem wochenlangen Tauziehen einigten sich China und die Europäische Union auf Mindestpreise für Importe chinesischer Solarprodukte in die EU, wie EU-Handelskommissar Karel De Gucht am Samstag in Brüssel schriftlich mitteilte. Auch eine Mengenbegrenzung soll es geben. De Gucht sprach von einer „freundschaftlichen Lösung“.

    Nach Angaben von Diplomaten soll ein Mindestpreis von 56 Cent pro Watt gelten. Die Gesamtmenge der chinesischen Importe an Solarpaneelen in die EU soll gedeckelt werden, und zwar umgerechnet in Leistung auf sieben Gigawatt pro Jahr.

    Chinesische Firmen, die sich auf diese Bedingungen einlassen, müssen keine Strafzölle fürchten. Für alle anderen gelten ab dem 6. August Strafzölle in einer Spanne zwischen 37,2 und 67,9 Prozent, wie EU-Handelskommissar De Gucht am 6. Juni erklärt hatte. Etwa 90 Firmen dürften sich laut EU-Kommission beteiligen, das entspreche 60 Prozent der in der EU durch Solarpaneele erzeugten Leistung.

    Der Kompromiss zeige die „pragmatische und flexible Haltung beider Seiten“, sagte der Sprecher des Handelsministeriums, Shen Dayang, am Samstag in Peking. Die Einigung fördere „offene, kooperative, stabile und nachhaltige Wirtschafts- und Handelsbeziehungen zwischen China und der EU“, zitierte ihn die amtliche Nachrichtenagentur Xinhua.

    Empört reagierte die Brancheninitiative EU ProSun. Präsident Milan Nitzschke, nannte den Kompromiss rechtswidrig und einen „Skandal“, gegen den europäische Solarunternehmen vor dem Gerichtshof der EU in Luxemburg vorgehen wollten. „Die EU-Kommission ist China so weit entgegengekommen, dass sie den Boden des europäischen Handelsrechts verlassen hat“, sagte Nitzschke am Samstag der Nachrichtenagentur dpa.     During the weekend, 27 July 2013, EU Trade Commissioner Karel De Gucht stated: “We found an amicable solution in the EU-China solar panels case that will lead to a new market equilibrium at sustainable prices”
    "After weeks of intensive talks, I can announce today that I am satisfied with the offer of a price undertaking submitted by China’s solar panel exporters, as foreseen by the EU’s trade defence legislation. This is the amicable solution that both the EU and China were looking for.

    We are confident that this price undertaking will stabilise the European solar panel market and will remove the injury that the dumping practices have caused to the European industry. We have found an amicable solution that will result in a new equilibrium on the European solar panel market at a sustainable price level.

    Upon consultation of the advisory committee composed of Member States, I intend to table this offer for approval by the European Commission.” More information can be found here.

    Because of the outstanding consultation with the advisory committee, no further details of the agreement have been officially published, yet. EPIA will therefore only comment on any figures once the European Commission has published more information.

    In any case, EPIA would welcome a swift and reciprocal end of the PV trade conflict between EU and China.
